Informed Consent for Assessments

This Informed Consent for Assessments document outlines the terms and conditions under which Cogford provides its standardized educational assessment services. By proceeding with a booking and engaging in our assessment services, you acknowledge that you have read, understood, and agree to the terms herein. This document serves as a formal agreement between Cogford and the Client (parents/guardians or schools) for the provision of assessment services.
1. Introduction and Acceptance of Terms
By booking an assessment with Cogford, you are providing your informed consent for the assessment to be conducted in accordance with the terms and conditions detailed in this document. Your acceptance signifies your understanding of the nature of our services, the assessment process, and your rights and responsibilities as a Client. This consent is crucial for ensuring transparency and mutual understanding throughout the assessment journey.
2. Definitions
•Cogford, we, us, our: Refers to the entity providing the educational assessment services.
•Client: Client: Refers to parents/guardians engaging Cogford's services for an assessment on behalf of their child. Schools may be authorized by parents/guardians to receive assessment reports but are not parties to this consent agreement.
•Assessment: Refers to the standardized educational assessments administered by Cogford.
•Services: Refers to the standardized educational assessments, reporting, and related consultancy services offered by Cogford.
•Report: Refers to the personalized assessment outcome document provided by Cogford.
•Assessed Individual: Refers to the child or individual undergoing the assessment.
3. Description of Services
Cogford administers standardized educational assessments that are widely used and recognized internationally. These assessments are conducted by trained professionals who adhere strictly to standardized administration and scoring protocols. The primary purpose of these assessments is to help families and schools understand how an assessed individual thinks, learns, and approaches problem-solving. Our assessments provide standardized insights into cognitive abilities, which can support educational planning and school readiness. It is important to understand that while these assessments offer valuable insights, they represent only one component of an individual's overall learning journey.
4. Booking, Payments, Rescheduling, and Cancellations
All bookings for assessments are subject to specific terms and conditions, which will be clearly communicated to you. These terms cover aspects such as scheduling, payment obligations, and policies regarding rescheduling and cancellations. Detailed timelines and any associated fees will be explicitly outlined in your booking confirmation email. Please be aware that changes requested after a specified notice period may incur additional charges. Cogford reserves the right to update these policies periodically; however, the terms provided in your booking confirmation at the time of scheduling will be the ones applicable to your specific assessment.
5. Confidentiality and Data Protection
Cogford is committed to maintaining the confidentiality of all assessment results and personal information. Each Report generated is personalized and will be shared exclusively with the parents/guardians of the assessed individual and any schools explicitly approved by the parents/guardians. Reports are individualized and confidential, prepared solely for the assessed individual and authorized stakeholders. All personal data collected during the assessment process will be handled in strict accordance with the Digital Personal Data Protection Act, 2023 and other applicable Indian data protection laws.
6. Intellectual Property and Test Security
All assessment materials used by Cogford are standardized, proprietary, and protected by intellectual property laws, including copyright. This includes, but is not limited to, specific test content, test items, scales, scoring algorithms, and assessment formats. Consequently, specific test content cannot be publicly shared or disclosed. As a Client, you agree not to reproduce, distribute, display, or otherwise disseminate any assessment materials or their components without the prior written permission of Cogford. Any unauthorized use or disclosure of these proprietary materials is strictly prohibited and may result in legal action.
7. Client Obligations
As a Client, you agree to provide accurate, complete, and truthful information during the booking process and throughout the assessment administration. This includes, but is not limited to, demographic details, relevant educational history, and any specific concerns regarding the assessed individual. Furthermore, to maintain the integrity and validity of the assessment process, Clients must not attempt to coach the assessed individual on specific test content or engage in any activities that could compromise the standardization or fairness of the assessment. Full cooperation and honesty are essential for accurate and meaningful results.
8. Disclaimers and Limitations of Assessment
It is crucial to understand that Cogford's assessments are designed as educational tools and are not intended to serve as medical, clinical, or psychological evaluations or diagnoses. The results provided offer insights into cognitive abilities but should not be interpreted as definitive medical or clinical statements. The performance of an assessed individual can be influenced by various factors, including language exposure, comfort level during the assessment, previous learning experiences, cultural background, prior learning opportunities, and the specific testing conditions. Therefore, assessment results should always be interpreted in conjunction with other relevant information, such as academic history, teacher observations, and other pertinent data. Cogford limits its liability for any educational outcomes or decisions made by Clients based on the assessment results, as these results are only one piece of a comprehensive understanding of an individual's learning profile.
9. Assessment Data and Norming
The assessment tools used by Cogford are internationally standardized instruments. As is standard practice for all such instruments, anonymized and aggregated assessment results may be contributed to the ongoing norming and standardization processes of our assessment tool providers. No personally identifiable information is shared in this process. By proceeding with this consent, you acknowledge and agree to this use of anonymized data.
10. Data Retention
Assessment reports and associated personal data are retained for 10 years from the date of assessment, after which they are securely deleted unless you request earlier deletion or provide consent for extended retention for longitudinal tracking purposes.
